Implementation of Leave Rules

PERSONNEL, PUBLIC GRIEVANCES AND PENSIONSbe pleased to state:-


(a) whether the Government has implemented the recommendations of the 7th Central Pay Commission related to Leave rules and if so, the details thereof;

(b) the details of extant rules for Compensatory Holiday and Special Casual Leave for staff of Central Government;

(c) whether compensatory leaves can be availed by a Gazetted Officer within the stipulated time of twelve months which was earned while he/she was a non-gazetted staff, if so, the details thereof and if not, the reasons therefor;

(d) whether any leave/benefits are provided to the gazetted officer for attending to official works on sundays/ holidays, if so, the details thereof and if not, the reasons therefor;

(e) whether there is urgent need for provision in Leave rules to permit sharing of Child Care Leave (CCL) between Government spouse, similarly like recent provision by Government for CCL for single male parent; and

(f) if so, the steps taken by Government in this regard?

(a): Yes Madam. On the recommendations of the 7th Central Pay Commission (CPC) relating to leave, the provisions of the Central Civil Services (Leave) Rules, 1972 [CCS (Leave) Rules, 1972] have been amended which have come into force w.e.f. 14.12.2018. As per amended Rules, Earned Leave (EL) has been allowed to the employees of Vacation Departments in place of Half Pay Leave; Child Care Leave (CCL) has been allowed to single male Government servants also and Work Related Illness & Injury Leave (WRIIL) has been provided to Government servants who suffer illness or injury that is attributable to or aggravated in performance of official duties. Further, Study Allowance has been abolished w.e.f. 03.01.2018.

(b) & (c): Compensatory Leave is granted to a non Gazetted staff in lieu of duty performed on Sundays or holidays. Such Leave is to be allowed within a month of its becoming due. As per the CCS (Leave) Rules, 1972, Central Government servants can avail Special Casual Leave upto a maximum of 30 days in a calendar year for participating in sports and cultural activities, mountaineering/trekking expeditions, family planning, Union/Association activities and other miscellaneous matters.

(d): At present, there is no provision for any compensatory leave benefit available to the Gazetted Officers for attending to official work on Sundays/holidays. However, subject to the exigencies of work, Government servants can avail various other kinds of leave under the CCS (Leave) Rules, 1972.

(e) & (f): Government servants can avail various kinds of leave under the CCS (Leave) Rules, 1972 such as Earned Leave, Half Pay Leave, Extraordinary Leave, Paternity Leave, which can be utilized for taking care of children. Hence, there is no proposal for allowing sharing of CCL between spouses in Central Government.
