Sub: Implementation of recommendations of the 6th CPC regarding restoration of HPL facilities to teachers etc. - demand for 20 days HPL in addition to 10 days earned leave on the analogy of college teachers.
Respected Sir,
All India Navodaya Vidyalaya Staff Association (AINVSA) would like to draw your kind attention towards an Office Memorandum No. 13013/2/2008-Estt.(L) dated 11th November 2008 issued by the Department of Personnel & Training vide which the facility of 20 days’ half pay leave has been restored to teachers, Principals, Headmasters, Librarians, Laboratory Assistants and Waterman working in schools with effect from 1st September 2008. Through the said OM dated 11th November 2008, earlier Office Memorandum No. 18011/3/80-Estt. (Leave) dated 3rd September 1981 and Notification of even number dated 28th July 1984 have been superseded. As a consequence, the facility of 10 days’ full pay earned leave provided to the teachers vide above mentioned Office Memoranda has been withdrawn with effect from 1st September, 2008.
Prior to 1st September 1981, these categories were entitled to 20 days half pay leave in a year. But they were facing many hardships while availing these half pay leave such as producing Medical Certificate each time they wanted to avail leave on full pay. It was not possible to attend to studies, examination and going on outstation tour etc. on full pay. They therefore, demanded earned leave like College teachers. Instead of granting the facility of earned leave in addition to half pay leave, the Central Government, after personal intervention of Mrs. Indira Gandhi, former Prime Minister, issued orders of conversion of 20 days half pay leave into 10 days earned leave on full pay with effect from 1st September, 1981 as a special case.
The teachers are thus, deeply anguished over the loss of 10 days earned leave, a facility gained after much deliberations, agitation and only after the personal intervention of Late Mrs. Indira Gandhi, the then Prime Minister of India in 1981. The present Government has undone the bold and beneficial decision of Mrs. Gandhi’s Government by unwittingly implementing the recommendation of the Sixth Central Pay Commission.
The Association submits following facts in this regard for your kind consideration:
- The superseded O.M. No. 18011/3/80-Estt. (Leave) dated 3rd September 1981 states, “A demand was made by the teachers working under the Central Government that they may be allowed earned leave which is hitherto not admissible to them under the provisions of Rule 28 of the CCS (Leave) Rules, 1972… This question has been considered by the Government and it has been decided, as a special case, … the teachers working under the Central Government, including the Union Territories….will henceforth be permitted to earn 10days’ earned leave on full pay during a year, in lieu of 20 days’ half pay leave, as permissible at present.” It may be understood from the text of the O.M. that 20 days half pay leave were converted into 10 days full pay earned leave on the demand of the teachers. They never complained against the earned leave.
- The demand was restoration of half pay leave on the analogy of University and college teachers in addition to earned leave and not at the cost of earned leave.
- The Sixth Central Pay Commission nowhere has recommended a conversion of earned leave into half pay leave. The relevant recommendation of the Commission in Para 4.5.6 of its Report is reproduced here under for your kind perusal:
“…From 1/9/1981, Teachers, Principals and Head Masters working in schools and from 28/7/1984, Librarians, Laboratory Assistants and Watermen working in schools have not been allowed the facility of half pay leave. This facility needs to be restored for these categories as the present rules place them in difficulties in times of sickness, etc. These categories should be made eligible for half pay leave on par with other Central Government employees.”
It is therefore, unfortunate and arbitrary besides being unjust that the Department of Personnel & Training, while implementing the recommendation of the 6th CPC did not examine the issue in its right perspective. On the contrary, the Department has drawn its own conclusions and acted in a manner which is against the true spirit behind the recommendation.
Since the DoPT is in the process of amending the CCS (Leave) Rules, 1972 to abolish sub rule (1) of the Rule 28, teachers are agitating and demanding that the DoPT should withdraw the above said O.M. dated 11th November 2008 and also desist from abolishing earned leave by amending the CCS (Leave) Rules.
The Association appeals you to use your good offices and support teachers’ legitimate demand and impress upon the Central Government to implement the recommendation of the Sixth Central Pay Commission of restoration of 20 days half pay leave in addition to existing 10 days earned leave on the analogy of College and University teachers.
